UPDATE: Victor Ponta (2009): "Eu sper ca presa are curaj sa faca o Lege a presei. Eu imi doresc sa traiesc intr-un cadru legal si organizat si sunt convins ca foarte multi din presa si-ar dori sa aiba un cadru legal si clar, dar e un deziderat." LINK
Nota: asa cum am scris si in stirea anterioara, avem o Lege a presei in vigoare.
ARTICLE 10
Everyone has the right to freedom of expression. this right shall include freedom to hold opinions and to receive and impart information and ideas without interference by public authority and regardless of frontiers. This article shall not prevent States from requiring the licensing of broadcasting, television or cinema enterprises.
The exercise of these freedoms, since it carries with it duties and responsibilities, may be subject to such formalities, conditions, restrictions or penalties as are prescribed by law and are necessary in a democratic society, in the interests of national security, territorial integrity or public safety, for the prevention of disorder or crime, for the protection of health or morals, for the protection of the reputation or the rights of others, for preventing the disclosure of information received in confidence, or for maintaining the authority and impartiality of the judiciary.
Article 17
1. No one shall be subjected to arbitrary or unlawful interference with his privacy, family, home or correspondence, nor to unlawful attacks on his honour and reputation.
2. Everyone has the right to the protection of the law against such interference or attacks.
ARTICOLUL 30
(6) Libertatea de exprimare nu poate prejudicia demnitatea, onoarea, viaţa particulară a persoanei şi nici dreptul la propria imagine.
(7) Sunt interzise de lege defăimarea ţării şi a naţiunii, îndemnul la război de agresiune, la ură naţională, rasială, de clasă sau religioasă, incitarea la discriminare, la separatism teritorial sau la violenţă publică, precum şi manifestările obscene, contrare bunelor moravuri.
ARTICOLUL 31
(3) Dreptul la informaţie nu trebuie să prejudicieze măsurile de protecţie a tinerilor sau securitatea naţională.
(4) Mijloacele de informare în masă, publice şi private, sunt obligate să asigure informarea corectă a opiniei publice.
Cind presa nu reuseste sa ramina in limitele stabilite prin propriile coduri deontologice, cind acesta uita ca are nu numai drepuri, dar mai ales OBLIGATII,, cind puterea judecatoreasca hotaraste dezlegata la ochi si cind constatam faptul ca insulta si calomnia n-au fost niciodata pedepsite suficient de ferm in Romania, trebuie cautate noi modalitati prin care presei sa i se aduca aminte libertatea de exprimare este o valoare la care societatile democratice apeleaza cu responsabilitate, discernamint si masura.
